Terms and conditions

These Terms and Conditions pertain to the remote purchase of products, via the Internet, from the website www.1896cosmetics.eu (hereinafter, site).

The Owner of this site is Farmacia Vito Giuseppucci, registered business in P.le Matteotti 20 - 60044 Fabriano (AN), VAT reg. no.00590320420.

Farmacia Vito Giuseppucci may amend these Terms and Conditions at any time and without prior notice.

1. Sales conditions

All purchases of products carried out through the site are governed by these Terms and Conditions and by Italian Consumer's Code.

By placing an order, the Customer declares to have read all the information provided during the purchase process, and to accept these Terms and Conditions. The contract between Farmacia Vito Giuseppucci and the Customer is intended to be stipulated upon Farmacia Vito Giuseppucci's partial or full acceptance of the order. This acceptance is automatic, unless communicated otherwise.

Farmacia Vito Giuseppucci reserves the right not to accept the order, by informing the Customer in a timely manner.

If the Customer is also the Consumer (i.e. a person who buys goods for purposes not related to his / her profession), after completing the online purchase process, he / she will print or save an electronic copy of these Terms and Conditions, subject to the requirements of Art. 3 and 4 of Italian Decree No. 185 /1999.

The Customer is not entitled to damages or compensation; Farmacia Vito Giuseppucci does not accept any contractual or extra-contractual responsibilities for direct or indirect damages which may be suffered in connection with partial or full non-acceptance of the order.

2. How to make a purchase

The Customer can purchase any products available on the site at the time of the order registration, as described in the product information pages.

The order registration is confirmed with an e-mail sent to the address provided by the Customer. This confirmation message will contain date and time of the order, together with a 'Customer Order Number' to be used in any further communication with Farmacia Vito Giuseppucci.

The Customer agrees to check the accuracy of his / her data and to communicate any rectifications in a timely manner.

3. Payment methods

Credit card with Paypal

After confirming the order, the Customer will be redirected to PayPal secure server, which uses the security system SSL (Secure Socket Layer) 168-bit. Currently, this system represents the safest standard for protecting information transmitted over the Internet.

PayPal Account

After confirming your order, you will need to access your Paypal account to proceed with the payment. By choosing this method, all you will need to provide is your email address together with your password.

Bank Transfer

In case of payment by bank transfer, the receipt must be sent to Farmacia Vito Giuseppucci by e-mail within 3 (three) working days from the order acceptance date. The item(s) purchased will only be dispatched once payment has reached our account; this must happen within 7 (seven) working days from the order acceptance date. Should the payment not reach our account within this time, the order will be cancelled.

4. Delivery and costs

All product(s) prices are clearly indicated on the site and include VAT. Shipping expenses are adequately displayed at the time of the order. The cost for each shipment may vary, depending on shipping and payment methods as well as final destination and total amount of the order.

Farmacia Vito Giuseppucci only trades in the Eurozone. The pharmacy will make deliveries through spediamo.it services. We chose it as the primary partner for the delivery of the goods purchased on our website directly to our Customers. For any orders placed on the site, Farmacia Vito Giuseppucci will issue an invoice in relation to the goods sent to the Customer, pursuant to Article 14 of Italian Presidential Decree 445/2000 and DL 52 /2004. The information provided by the Customer will be used to issue the invoice. No changes to this information are allowed once the invoice has been issued.

All delivery costs are charged to the Customer. No responsibilities can be assigned to Farmacia Vito Giuseppucci for any delays in the order process or in the delivery of the ordered goods.

Prices and delivery times

The cost of shipping is automatically calculated during the checkout process and varies depending on the type of payment, as well as on the Customer's location. In order to receive a good service, we recommend to:

- Ensure you fill in any information that may be of help to the shipping company, by using the text box provided in the   
  order and addresses forms.

- Provide a telephone number at which the courier can track the Customer in the event of any delivery problems

Shipment issues

In the event of any shipment issues please write an email to assistenza@1896cosmetics.com, indicating the nature of the problem and the order details.

Upon delivery of the goods it is the Customer's responsibility to verify that the number of packages delivered corresponds to that indicated in the transport document received by e-mail. The Customer should also verify that the packaging is not damaged, or otherwise altered; this also applies to the sealing materials.

Any damages to the packaging and / or product(s) as well as any discrepancies in the number of packages must be immediately notified to Farmacia Vito Giuseppucci.

Any problems concerning integrity, correspondence or completeness of the product(s) received must be reported within 7 (seven) days from delivery, as provided herein.

In the case of inability to deliver to the address specified by the Customer, the order will be sent back at the warehouses of Farmacia Vito Giuseppucci.

5. Right of withdrawal

If the Customer is also a Consumer (i.e. an individual who purchases the merchandise for purposes that are not related to their professional activity, without indicating a VAT Registration number), he / she has the right to withdraw from the purchase agreement for any reasons, without explanation and without penalty, under the terms stated below.

To exercise this right, the Customer must send Farmacia Vito Giuseppucci a withdrawal notice within 10 (ten) working days from the date of receipt of the goods. This can be done by completing our contact form (by selecting Customer Service) or by writing an e-mail to assistenza@cosmetics.com stating the order details.

Farmacia Vito Giuseppucci will promptly instruct the Customer on how to return the goods.
These must be returned intact, preserved with all parts and original packaging (bags and packaging), completely sealed.

The right of withdrawal is subject to the following conditions:

- The product(s) must be returned intact and in its original packaging, complete in all its parts.

- By law, the shipping costs for returning the goods shall be borne by the Customer; any delivery expenses as well as any
  other costs indicated at the time of the order will not be reimbursed to the Customer.

- The shipment falls under the responsability of the Customer up until confirmation of the product(s) arrival at the warehouse.

- If the goods are damaged during transportation, Farmacia Vito Giuseppucci will inform the Customer (within 5 working days
  of receipt of goods in their stores), to enable the Customer to file a timely complaint against the shipping company
  and obtain a refund for the value of the dispatched item(s), if insured: in this case, the product(s) will be made available to
  the Customer for the return and his / her request for withdrawal will be cancelled.

Farmacia Vito Giuseppucci will be not held responsible for any damages, thefts or loss of goods returned by uninsured shipments. The product(s) will be inspected for any damages upon arrival at the warehouse.

Farmacia Vito Giuseppucci will refund the Customer the full amount paid within 30 (thirty) days from the return of the goods by bank transfer or by any other methods agreed with the Customer. Please note that no shipping costs will be refunded.

6. Privacy

Farmacia Vito Giuseppucci will observe data protection laws and will not use information that can be used to personally identify you (i.e. your personal data) other than as set out in our Privacy Policy. By submitting your personal data in relation to your order, you consent to such personal data being processed to fulfill your requests, in accordance with our Privacy Policy and with Italian Legislative Decree n.196/2003.

8. Applicable legislation and controversies

Any claims, disputes, or controversies between the Customer and Farmacia Vito Giuseppucci shall be resolved by the competent judicial authority based on applicable laws.
